Article 1 With a view to standardizing the behavior of China Banking Regulatory Commission (hereinafter referred to as the CBRC) and its detached offices in administrative licensing of foreign-funded financial institutions, specifying the administrative licensing matters, conditions, applicable operating flows and terms, and safeguarding the lawful rights and interests of applicants, we worked out these Measures in accordance with such laws and administrative regulations as the Law of the People’s Republic of China on Regulation of and Supervision over the Banking Industry, the Law of the People’s Republic of China on Commercial Banks, the Administrative Licensing Law of the People’s Republic of China, the Regulations of the People’s Republic of China on the Administration of Foreign-funded Financial Institutions, as well as the relevant decisions of the State Council.
Article 2 These Measures shall be applicable to solely-funded banks, joint-funded banks, solely-funded financial companies, joint-funded financial companies, branches of foreign banks and representative offices of foreign-funded financial institution in China as specified in the Regulations of the People’s Republic of China on the Administration of Foreign-funded Financial Institutions and the Measures for the Administration of Representative Offices of Foreign-funded Financial Institutions in China. The foreign-funded corporate institutions as mentioned in these Measures refer to solely-funded banks, joint-funded banks and solely-funded financial companies and joint-funded financial companies.
Article 3 The CBRC and its detached institutions shall, in accordance with these Measures and the Regulations of China Banking Regulatory Commission on the Procedures for Administrative Licensing, grant administrative licenses to foreign-funded financial institutions.
Article 4 The following matters of a foreign-funded financial institution shall be subject to the administrative licensing of the CBRC or its detached office: establishment, alternation or termination of the institution, adjustment of the business scope, addition of new business varieties, qualifications of senior managers, etc.
Article 5 The materials as required by these Measures, with the exception of annual reports, shall be accompanied by a Chinese version if they are written in a foreign language. An annual report printed in a foreign language other than Chinese or English shall be accompanied by a Chinese or English version.
Article 6 Any material as required by these Measures, if required to be signed by the authorized party, shall be accompanied by a letter of authorization. With the exception of the photocopy of a2587
